These Terms of Use govern the use of the TerraSOS mobile application ("App"). By downloading, installing, accessing, or using the App, you agree to be bound by these Terms of Use. If you do not agree to these Terms, you must not use the App.

1. Purpose of the Application
TerraSOS is designed to assist users in identifying local emergency numbers, initiating emergency calls, and displaying essential emergency communication phrases and information (such as location data) in different languages.
The App is intended solely as a supportive informational tool. TerraSOS does not replace official emergency services, including but not limited to medical services, rescue services, law enforcement agencies, or other professional emergency response providers.
2. No Emergency Service
TerraSOS is not an emergency service provider. The App:
- does not operate emergency call centers
- does not dispatch emergency responders
- does not monitor emergency situations
- does not provide emergency response services
- does not guarantee successful connection to emergency services
Emergency calls are handled entirely by the user's mobile device and telecommunications provider. The App merely facilitates the dialing process where technically possible.
3. Connectivity Requirements
The proper functioning of the App depends on external conditions outside the control of Naptive GmbH. The App requires:
- a functioning mobile device
- a compatible operating system
- sufficient battery power
- access to a mobile or internet network
- availability of local emergency services
If any of these conditions are not met, emergency calls may fail. TerraSOS cannot guarantee the availability, reliability, or performance of emergency calls.
4. Translation and Information Disclaimer
The App may display translated emergency phrases in order to assist communication. These translations are provided for informational purposes only. Naptive GmbH does not guarantee the accuracy, completeness, contextual correctness, or reliability of translations. Translations may contain inaccuracies, omissions, or misunderstandings. Users remain fully responsible for verifying the appropriateness of any communication.
5. No Medical or Legal Advice
Information provided within the App is not medical, legal, or professional advice. The App must not be relied upon as a substitute for professional assistance. Users should always contact appropriate emergency services in critical situations.
6. Limitation of Liability
To the maximum extent permitted by applicable law, Naptive GmbH and its affiliates, directors, employees, contractors, and partners shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from or related to the use or inability to use the App. This includes, but is not limited to:
- failure to initiate an emergency call
- delayed emergency response
- incorrect translations
- device malfunction
- network failures
- user misuse of the App
- incorrect emergency numbers
- software bugs or interruptions
- incorrect location data
- telecommunications failures
Users acknowledge that emergency communication systems depend on multiple external infrastructures outside the control of the App.
7. No Guarantee of Availability
The App is provided on an "as-is" and "as-available" basis. Naptive GmbH makes no guarantees regarding uptime, availability, reliability, or uninterrupted operation. The App may be updated, modified, suspended, or discontinued at any time without notice.
8. User Responsibility
Users are solely responsible for:
- ensuring their device is functional
- maintaining sufficient battery power
- ensuring network availability
- understanding local emergency procedures
- verifying the suitability of the App for their circumstances
The App must not be relied upon as the sole method of accessing emergency services.
9. No Warranty
To the fullest extent permitted by law, the App is provided without warranties of any kind, whether express or implied. This includes but is not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, reliability, or accuracy.
10. Third-Party Services
The App may rely on third-party technologies, operating systems, or telecommunications networks. Naptive GmbH has no control over these services and cannot guarantee their availability, reliability, or performance.
11. Changes to the Application
We may modify or update the App at any time to improve functionality, security, or compliance. Users may be required to install updates in order to continue using certain features.
12. Termination
We may suspend or terminate access to the App at any time if necessary for operational, legal, or security reasons.
13. Governing Law
These Terms are governed by the laws of Switzerland. Any disputes arising from or relating to these Terms shall be subject to the jurisdiction of the competent courts of Switzerland.

The App is designed solely as an auxiliary informational tool to assist users in initiating emergency calls and communicating basic information. TerraSOS must not be relied upon as the sole or primary method of contacting emergency services.
Users should always ensure that they are familiar with local emergency numbers and procedures and have alternative methods available to contact emergency services if necessary. Naptive GmbH does not warrant that the App will function correctly in all emergency situations or under all technical conditions. The App may not function properly in situations including, but not limited to:
- lack of network coverage
- device malfunction
- low battery
- operating system restrictions
- regional telecommunications limitations
- emergency service availability
Users acknowledge that emergency response systems depend on multiple external infrastructures beyond the control of the App.
16. Indemnification
By using the App, users agree to indemnify and hold harmless Naptive GmbH, its directors, employees, contractors, and partners from and against any claims, damages, liabilities, losses, or expenses arising out of or related to:
- misuse of the App
- reliance on the App in emergency situations
- failure to contact emergency services through appropriate channels
- incorrect interpretation of information or translations provided by the App
- violation of these Terms of Use
This indemnification applies to the maximum extent permitted by applicable law.
